§ 38-25. Operation on public streets or roads.

  • It is unlawful to operate a golf cart on a public street or road within the town unless the following requirements are met:

    (1)

    The golf cart may only be operated on public highways, streets and roads that meet the requirements in section 38-26.

    (2)

    No person may operate a golf cart unless that person is licensed to drive upon the streets and highways of state, and then only in accordance with such driver's license. An operator of golf cart must be at least 16 years of age, with the exception that operators under the age of 16 years may operate golf carts if they possess a valid learner's permit issued by the state and are accompanied by a licensed driver as required by state law.

    (3)

    No golf cart may be operated at a speed greater than reasonable and prudent for the existing conditions, and in no instance a speed greater than 20 miles per hour.

    (4)

    No golf cart may be operated in a careless or reckless manner.

    (5)

    Golf carts must be operated to the extreme right of the roadway and must yield to all vehicular and pedestrian traffic.

    (6)

    Golf carts may be operated only during daylight hours, with the exception that golf carts equipped with operating lights and reflectors meeting the requirements set forth as follows may operate for one hour before sunrise and one hour past sunset:

    Two clear headlamps, one on each side of the front of the golf cart, visible under normal atmospheric conditions from a distance of at least 500 feet in front of such golf cart, and a red lamp on the rear, exhibiting a red light visible under like conditions from a distance of at least 300 feet to the rear of such golf cart.

    (7)

    Golf carts must be operated in accordance with all applicable state and local laws and ordinances, including all laws, regulations and ordinances pertaining to the possession and use of alcoholic beverages.

    (8)

    The chief of police or his designee may prohibit or limit the operation of golf carts on any public highway, street or road if the chief determines that the prohibition is necessary in the interest of safety.

    (9)

    No golf cart shall be operated within the town without having in full force and effect the financial responsibility sufficient to cover the risk involved in operating a golf cart on public streets. To wit, a minimum of full liability insurance.

    (10)

    Before any golf cart can be operated within the town, the cart must be registered with the police department. The golf cart must be brought to the police department by some other means than driving it. There the chief of police or his designee will inspect the golf cart. Upon successful completion of inspection, the owner or registering person of the golf cart will pay a $10.00 fee and receive a windshield decal that will be good for one year from the date of purchase. Monies shall be paid at the town hall.
